DMCA Copyright Policy

VatioLibre respects the intellectual property rights of others and expects users of its services to do the same. This page explains how copyright owners may report allegedly infringing material and how affected users may submit a counter-notification when they believe content was removed because of mistake or misidentification.

Reporting Copyright Infringement

A copyright owner or a person authorized to act on the owner's behalf who believes material hosted through VatioLibre infringes copyright may submit a written notification to the designated agent. The notification should include substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works at a single online site are covered by one notification, a representative list of those works.
  3. Identification of the material claimed to be infringing or the subject of infringing activity, and information reasonably sufficient for VatioLibre to locate it. Include the exact VatioLibre URL and any available content, vehicle, listing, post, or other relevant identifier.
  4. Information reasonably sufficient to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

When VatioLibre removes or disables access to content following a copyright complaint, the affected user may submit a written counter-notification if the user believes the material was removed or disabled because of mistake or misidentification. A counter-notification should include substantially the following:

  1. The user's physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and the location where the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that the user has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. The subscriber's name, address, and telephone number.
  5. A statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

What Happens After a Counter-Notification

VatioLibre may provide a valid counter-notification to the person who submitted the original notification. Under the process described in 17 U.S.C. § 512(g), removed material may generally be replaced, or access restored, not less than 10 and not more than 14 business days after receipt of the counter-notification unless the designated agent first receives notice that the original complaining party has filed an action seeking a court order concerning the material.

This process does not guarantee that material will be restored. VatioLibre may consider applicable law, court orders, other legal obligations, and separate violations of its Terms of Service.

Repeat Infringers and User Content

Users must have the rights or authorization necessary for content they upload or synchronize and must not upload infringing content. VatioLibre may remove or disable access to content and may suspend or terminate, in appropriate circumstances, accounts of users who repeatedly infringe copyrights or other intellectual-property rights.

Misrepresentations

Knowingly making a material misrepresentation that material or activity is infringing, or that material was removed or disabled because of mistake or misidentification, may have legal consequences under 17 U.S.C. § 512(f).
